Brenda Mediate First -resolve disputes without litigation
What is Mediation?
The method is used to prevent expensive legal action.
A confidential and cooperative problem-solving process that helps participants find their own solutions to a dispute with the assistance of a trained mediator
Mediators facilitate settlement of a dispute by using communication as a tool.
The Mediators come without an opinion or a view.
Why use Mediation
Voluntary
Quick and Efficient
Less stressful than litigation
Parties explore issues rather than maintain pre-determined positions
Parties’ own decisions.
Process- what to expect
There are varying methods or approaches. Parties separated, parties in the same room, etc
The Mediator facilitates the resolution by clear communication taking into account the circumstances.
Tips for Mediation
“Discourage litigation. Persuade your neighbours to compromise whenever possible. Point out to them how the nominal winner is often a loser - in fees, expenses and waste of time.”
